WHAT: Confusion regarding the visa-free entry privileges granted to the foreign spouses and children of former Filipino citizens (the Balikbayan privilege).
WHERE: Philippine international airports (ports of entry).
THE REALITY: Under Philippine law, the foreign spouse and unmarried children under 21 of a former Filipino citizen are entitled to the same visa-free entry privileges as the former Filipino, provided they enter the Philippines together with the former Filipino. This grants a one-year, visa-free stay. The immigration officer will stamp the foreign spouse’s passport with a one-year “Balikbayan” privilege. The primary trigger for this privilege is the joint entry; the foreign spouse does not need to hold a Philippine passport, but must be traveling with their eligible spouse.
WHEN REPORTED: Ongoing. This is a long-standing, codified provision of the Philippine Immigration Act.
SOURCE: Philippine Immigration Act of 1940 (as amended by RA 9174 and related Balikbayan laws). STATUS: Confirmed. This is a legal right, provided the strict condition of joint entry is met.
WHAT TO DO: Always enter the Philippines at the same time and through the same immigration lane as your former Filipino spouse. Carry physical copies of your PSA-authenticated marriage certificate and your spouse’s Philippine birth certificate or old passport. Do not attempt to use this privilege if you are entering the Philippines separately from your spouse.
